End User License Agreement (EULA)

This End User License Agreement ("Agreement") is a legal agreement between you ("you" or "User") and Mind the Farm ("we," "us," or "Company") governing your use of the Mind the Farm mobile application and related services (the "App"). By downloading, installing, or using the App, you agree to be bound by this Agreement. If you do not agree, do not use the App.

This Agreement is between you and Mind the Farm only, and not with Apple Inc. ("Apple"). Mind the Farm — not Apple — is solely responsible for the App and its content.

Subject to your compliance with this Agreement, Mind the Farm grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on any Apple-branded device that you own or control, as permitted by the Apple Media Services Terms and Conditions, solely for your personal or internal farm-management use.

You agree not to:

• Copy, modify, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App, except as permitted by applicable law
• Rent, lease, lend, sell, sublicense, or otherwise transfer the App to any third party
• Remove any proprietary notices or labels on the App
• Use the App for any unlawful purpose or in violation of any applicable laws or regulations
• Use the App to transmit viruses, malware, or other harmful code
• Attempt to gain unauthorized access to the App, our servers, or other users' data

The App offers auto-renewable subscriptions. By purchasing a subscription, you agree to the following:

• Payment will be charged to your Apple ID account at confirmation of purchase
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the cost of the chosen package
• You can manage and cancel subscriptions by going to your Apple ID account settings after purchase
• Any unused portion of a free trial period will be forfeited when you purchase a subscription

Subscription prices, duration, and features are disclosed on the in-app purchase screen at the time of subscription.

You retain all rights to the data you enter into the App, including animal records, breeding records, health events, tasks, and notes ("Your Data"). You grant Mind the Farm a limited license to process Your Data solely to provide and improve the App.

We do not sell Your Data. Our handling of Your Data is described in our Privacy Policy, which is incorporated into this Agreement by reference.

The App includes AI-powered features that use third-party AI services to assist with farm management. AI responses are generated based on the data you provide and may not always be accurate. AI output is not a substitute for professional veterinary, legal, financial, or agricultural advice. Always consult a qualified professional before making decisions about animal health, breeding, medication, or business operations.

You are solely responsible for verifying any information or recommendations produced by the App before acting on them.

Mind the Farm is solely responsible for providing any maintenance and support services for the App, as required under applicable law. Apple has no obligation whatsoever to provide any maintenance and support services with respect to the App.

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Mind the Farm does not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. To the maximum extent permitted by law, in the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be Mind the Farm's sole responsibility.

TO THE FULLEST EXTENT PERMITTED BY LAW, MIND THE FARM WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR LIVESTOCK, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, REGARDLESS OF THE THEORY OF LIABILITY.

In no event will Mind the Farm's total liability to you exceed the amount you paid for the App and subscriptions in the twelve (12) months preceding the claim, or one hundred U.S. dollars ($100), whichever is greater.

Mind the Farm, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

You acknowledge that, in the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, Mind the Farm — not Apple — will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

All rights, title, and interest in and to the App (excluding Your Data) remain with Mind the Farm and its licensors.

You represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

You agree to comply with any applicable third-party terms when using the App (for example, your wireless data service agreement). You acknowledge that Apple and its subsidiaries are third-party beneficiaries of this Agreement, and that, upon your acceptance of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary.

This Agreement is effective until terminated by you or Mind the Farm. Your rights under this Agreement will terminate automatically without notice if you fail to comply with any of its terms. Upon termination, you must cease all use of the App and delete all copies from your device.

We may update this Agreement from time to time. Material changes will be communicated through the App or by email. Continued use of the App after changes take effect constitutes acceptance of the revised Agreement.

This Agreement is governed by the laws of the State of South Carolina, United States, without regard to its conflict of law principles. Any dispute arising out of or relating to this Agreement will be resolved in the state or federal courts located in South Carolina, and you consent to the exclusive jurisdiction of those courts. This choice of law does not apply to consumer protection laws of your jurisdiction that grant you additional rights.
